Terms

Thank you for using MakerTech! Before utilizing our platform, please read these terms of service (hereinafter - Terms of Service) deliberately. This document is a legally binding contract between MakerTech and you (hereinafter - User) to use the services provided by MakerTech. As such, MakerTech has tried to make it as straightforward as possible.

General

When using MakerTech services and content, The User agrees to our Terms of Service and Privacy Policy.

Except as additional terms and conditions may supplement policies, guidelines, or standards, the agreement constitutes the entire understanding between Makertech and User about the subject matter hereof. Therefore, it supersedes any prior oral or written understandings or agreements between MakerTech and User concerning the access to and use of the Terms of Service.

MakerTech is a new brand - a platform for small manufacturers, designers, and their customers to promote cooperation between make-up artists and designers, skills development, and acquisition of e-commerce. MakerTech embodies innovation, collaboration, growth, openness, professionalism, dynamism, and global reach.

As an enterprise, Makertech does not own, create, sell, resell, provide, control, manage, offer, deliver, or supply any products. Users alone are responsible for their products and the delivery of the product.

Privacy

It is crucial to ensure that The User is confident that MakerTech processes the User's data with due diligence. Therefore, MakerTech has implemented technical and organizational security measures to protect The User's data from unauthorized access and use. MakerTech encourages The User to read MakerTech privacy policy carefully.

MakerTech implements personal data protection with encryption tools, firewall protection, and other security breach detection solutions. The data controllers of the single platform of the MakerTech shall ensure the confidentiality of the data and implement appropriate technical and organizational measures to protect personal data against unauthorized access, unlawful processing, disclosure, accidental loss, distribution, or destruction, subject to applicable data protection safeguards and the extent necessary. Security measures for personal data are constantly being improved and refined to lower the level of protection of personal data.

Account

The User must be at least 18 years old and can access and use or create a MakerTech account. Minors under 18 and at least 13 years of age are only permitted to use MakerTech through an account owned by a parent or legal guardian under their direct supervision. Children under the age of 13 years are not allowed to use MakerTech. The User's are responsible for any account activity conducted by a minor on their account. In addition, there may be commercial products or services available that The User may consider limiting a minor's access to material online.

The User is solely responsible for any activity on his account. However, if the User is sharing an account with other people, the person whose financial information is on the account will ultimately be responsible for all activity.

The User understands and agrees that User is responsible for paying any applicable taxes due to User use of the MakerTech.

To create a MakerTech account, the User may be required to provide MakerTech with certain personal information, including the User's full legal name, current address, phone number, email address, and payment information. This information will be held and used following Makertech's Privacy policy. The User agrees to supply accurate and complete information to MakerTech, and that User will update that information promptly after it changes.

The User may terminate his account with MakerTech at any time from account settings. Terminating the User account will not affect the availability of some of the User content that the User-posted through MakerTech before termination. However, the User will still have to pay any outstanding bills.

MakerTech may terminate or suspend The User's account and access to the MakerTech should MakerTech have reason to believe The User, The User content, or The User use of the MakerTech violate our Terms. If MakerTech does so, it's essential to understand that The User doesn't have a contractual or legal right to continue to use MakerTech.

Content

All content uploaded is owned by the User. If MakerTech gets notified that the content is not User's or is against our standards, MakerTech will remove it at our discretion. By uploading content to MakerTech, the User allows MakerTech to use the content for marketing.

By posting content through MakerTech, The User grants MakerTech a license to use it. MakerTech doesn't claim any ownership of the User's content, but MakerTech has the User's permission to use it to help MakerTech function and grow. That way, MakerTech won't infringe any rights to Users Content, and MakerTech can help promote it.

The User can only post either theirs or for which the User has written authorization from the content owner. The User represents and warrants that any content the User post is owned by the User or that The User has permission from the content owner to post it.

By posting content, The User grants MakerTech a non-exclusive, worldwide, royalty-free, irrevocable, sub-licensable, perpetual license to use, display, edit, modify, reproduce, distribute, store, and prepare derivative works of User's content. This allows MakerTech to provide the services and to promote MakerTech services in general, in any formats and through any channels, including across any MakerTech services, MakerTech partners, or third-party website or advertising medium.

The User agrees that The User will not post any abusive, threatening, defamatory, obscene, vulgar, or otherwise offensive, or any part of our Terms. The User also agrees not to post any false and misleading content or use the MakerTech services fraudulently or deceptively.

The use of MakerTech

MakerTech grants The User a limited, non-exclusive, non-transferable, and revocable license to use MakerTech - subject to the terms.

The User agrees to not violate any laws in connection with their use of the MakerTech. May include any local, state, federal, and international laws applicable to the User.

The User is responsible for paying all fees owed to MakerTech. Except as set forth below, Users are also solely responsible for collecting and/or paying applicable taxes for any purchases or sales the User makes through MakerTech. For digital items sold to buyers in Australia, Belarus, Chile, the EU, Iceland, India, Indonesia, Japan, Malaysia, Mexico, Moldova, New Zealand, Norway, Quebec (Canada), Saudi Arabia, Serbia, Singapore, South Africa, South Korea, Switzerland, Taiwan, Turkey, United Arab Emirates, the United Kingdom or the United States.

The User agrees not to interfere with or disrupt MakerTech by distributing a virus or harmful computer code.

The name "MakerTech" and the other marks, phrases, logos, and designs that MakerTech uses in connection with MakerTech, are trademarks, service marks, or trade dress of MakerTech in Latvia and other countries.

Limitation of Liability

MakerTech does not manufacture, store, or inspect any items sold through MakerTech. MakerTech provides the venue; the items in our marketplaces are produced, listed, and sold directly by independent sellers, so MakerTech can't and does not make any warranties about their quality, safety, or even their legality. Any legal claim related to an item The User purchase must be brought directly against the seller. The User releases MakerTech from any claims related to items sold through our Services, including defective items, misrepresentations by sellers, or items that caused physical injury.

The User may come across materials that The User finds offensive or inappropriate while using MakerTech. MakerTech makes no representations concerning any content posted by users through MakerTech. MakerTech is not responsible for the accuracy, copyright compliance, legality, or decency of content posted by Users that the User accessed through MakerTech. The User releases MakerTech from all liability relating to that content.

Warranty Disclaimer. MAKERTECH DO NOT GUARANTEE THAT: (A) MAKERTECH WILL BE SECURE OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY DETECTED DEFECTS OR ERRORS WILL BE CORRECTED; (C) MAKERTECH WILL BE FREE OF VIRUSES OR OTHER HARMFUL MATERIALS, OR (D) THE RESULTS OF USING THE MAKERTECH WILL MEET THE USER'S EXPECTATIONS. THE USER USES THE MAKERTECH SOLELY AT THEIR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO THE USER.

 

Legal Issues with MakerTech

If MakerTech gets sued because of the User's mistake, The User agrees to defend and indemnify us. That means User will defend MakerTech (including any of our employees) and hold MakerTech harmless from any legal claim or demand (including reasonable lawyer's fees) that arises from User actions, User's use (or misuse) of our MakerTech, User breach of the Terms Of Service, or User's account's infringement of someone else's rights.

MakerTech reserve the right to handle legal defense; however, if MakerTech sees fit, even if The User is indemnifying MakerTech, in which case The User must agree to cooperate with MakerTech.

If a dispute arises from or relates to these Terms of Service, The User agrees to first contact MakerTech to resolve the issue. In addition, the dispute may be referred by either party to the Centre for Effective Dispute Resolution for mediation. The laws of the Republic of Latvia govern the Terms of Service. These laws will apply no matter where in the world the User lives. However, if the User lives outside of the European Union, the User may be entitled to the mandatory consumer protection provisions of their local consumer protection law.

Changes to the Terms

MakerTech has the right to update Terms of Service. The User is responsible for reviewing and becoming familiar with any changes. Following the changes, the User's use of the MakerTech constitutes their acceptance of the updated Terms.

Thank you for using www.makertech.com (hereinafter - MakerTech). Before using MakerTech, please read carefully this Privacy Policy, which explains how MakerTech protects your data (hereinafter - User) and respects The User's privacy.

MakerTech processes User data to provide MakerTech services. MakerTech needs the data to maintain the platform, provide services, keep The User informed of changes and upgrades, and offer The User all the latest products and services for marketing purposes.

Accepting our Terms of Use and Privacy Policy confirms that The User has read and understood MakerTech rules. However, regardless of its content, MakerTech is not responsible for the content or privacy policies or practices of MakerTech Users or third-party sites and applications.

MakerTech Terms of Use require all account owners to come of age (eighteen years). Minors under eighteen years and at least thirteen years are permitted to use MakerTech services only with the permission of a parent or a legal guardian. Children under the age of thirteen are not allowed to use MakerTech. The User is responsible for any account activity conducted by a minor on their account.

This policy applies to MakerTech customers, subscribers, and visitors.

Data we collect

In providing our MakerTech services, MakerTech collects or receives User's personal information in a few different ways. MakerTech welcome User's data from a variety of sources:

  • indirectly from The User based on their activity with MakerTech services, or from the device or browser The User uses to access the MakerTech services;

Registration and account setup

To use the MakerTech services, Users will need to submit a valid email address and a name associated with their account. In addition, the User will need to provide information such as a shop name, billing, and payment details (including billing contact name, address, telephone number, credit card information), a telephone number, and a physical postal address may be necessary provide a particular service. As a MakerTech seller, MakerTech will ask for the User's full name, identification ID, date of birth, bank account information, photograph, credit card information, or other proof of identification to verify User identity. User account name, the date User, joined the MakerTech platform, ratings, reviews, information relating to an items User review, related photos for items User purchased or sold, User profile information, items User listed for sale are publicly visible.

MakerTech automatically receives and records information from the User browser or mobile device when you visit the MakerTech, use the apps, or use certain features of the MakerTech services, such as your IP address, cookies, and data about which pages User visit and how the User interact with those pages.

MakerTech also automatically collects device-specific information when installing, accessing, or using MakerTech services. This information can include the hardware model, app version, app usage and debugging information, browser information, operating system information, IP address, and device identifiers. Data we obtain about the MakerTech services are for advertising, analytics, serving content, and protecting the MakerTech services.

MakerTech uses data analytics software to ensure MakerTech and app functionality and improve the MakerTech services. The software records data such as how often Users use the apps, what happens within the apps, aggregated usage, performance data, app errors and debugging information, and where the apps were downloaded from.

MakerTech receives or obtains information (for example, an email address or IP address) about a person who is not yet a registered MakerTechr member (a "non-member") in connection with certain MakerTech features. Non-member data is used only for the purposes disclosed when submitted to MakerTech, for purposes necessary to the functioning of MakerTech services.

Under the General Data Protection Regulation, the User can access the information MakerTech holds about the User. Including but not limited to:

  • the categories of data Makertech processing;
  • the purposes of data processing;
  • how long the data will be stored.

MakerTech will respond to User requests within one month unless doing so would adversely affect the rights and freedoms of third parties (e.g., another person's confidentiality or intellectual property rights).

Third parties who process your data

To deliver the best possible MakerTech experience, MakerTech often has to partner with third parties to provide services that MakerTech cannot. These include MakerTech partners that MakerTech works with to offer products and fulfill orders, services that support MakerTech communications, both internal and external, tools that keep MakerTech web platform and API running, services that allow MakerTech to study customer use of MakerTech platform and learn how to develop best.

Sometimes, MakerTech is forced to release User data, so the MakerTech services work well. However, information is transferred only when strictly necessary and according to this Privacy Policy and generally accepted practice.

Where we store data

MakerTech may store User data manually or electronically. MakerTech will store any data stored electronically in secure servers, and MakerTech will store any data stored manually in our premises within the Republic of Latvia.

How long do we store data

MakerTech will archive and stop any personally identifiable information about The User within six months from when the User used MakerTech. In addition, MakerTech will delete User data from MakerTech archives no later than six years from the last time the User used MakerTech or upon User request.
